1. Where these terms apply

These Terms and Conditions apply to the goods sold by the sole proprietorship of Sofia Hammam, with the distinctive title "eshop-spot", from its online store sportfree.gr. Every order you place through our online store implies acceptance of these terms and conditions.

2. Details of the E-SHOP seller
The seller of this online store is the sole proprietorship of Sofia Hamam, based in Thessaloniki (K. Karamanli 137), tel. 2310888174 & 2310888837, e-mail: info@eshop-spot.com

3. Order submission - Completion of the sale - Order cancellation

1. When you press the "Send Order" button, this means that you send eshop-spot proposal to purchase the products in your cart and agree to the application of these General Terms and Conditions of Purchase.

2. The confirmation of receipt of the purchase proposal, which is sent automatically immediately after submitting your order, certifies that your order has been received by sportfree. This, however, does not automatically constitute acceptance of your proposal for purchase, which will only be done after checking and establishing the availability of the products you order, at which point you will be sent a separate electronic message confirming acceptance. Sportfree expressly reserves the right to accept your proposal or not, depending on the availability of the products you have selected.

3. Any incorrect listing of products or payment method/shipping location by you is not the responsibility of sportfree, but of you.

4. You can cancel your order as long as it has not yet been shipped. You can submit the cancellation request either by phone, at 2310 888174 & 2310 888837, or by email at info@eshop-spot.com.

4. Product Availability

1. If the products ordered are not immediately available or are not available at the listed price due to a change in the listed price at the time the order is placed and processed, sportfree will inform you whether or not it accepts your order, as and about availability and applicable price or any delays in delivery. In case of non-acceptance, any payments you made in this case will be cancelled, in which case a return procedure will follow according to the payment method you chose.

2. sportfreechecks daily the correctness of the indicated prices of the products of the online store, however, in any case, it expressly reserves the right to any incorrect indication of price due to an error due to a human or technical factor, which (price) obviously could not correspond at usual or average sale price of the corresponding product. Sportfreewill inform you of any errors in the listed prices of products you ordered and the applicable price. Any payments you have made in this case will be cancelled.

3. In any case, you will be informed within 5 working days about the delivery time of your products.

5. Gift cards

Through our online store, you can purchase a gift card as a gift to a third party. In the event that you purchase a gift card, a unique code corresponding to the gift card will be issued, which will be sent via e-mail to the e-mail address of the person you select and declare when purchasing it. The gift card can be redeemed by the recipient in the following ways:

A) In our physical store (K. Karamanli 137) by anyone who holds the unique code of the gift card.
B) In our online store, by anyone who, after choosing the products they want, will use the gift card code as a payment method.

Gift cards are not a product or good, so they cannot be returned, as this is tantamount to cashing out the gift card. However, it is possible to return products purchased with a gift card, in accordance with what is provided in our returns terms.

In the event of a return of products purchased with the gift card, the return of their value will be made by crediting their value to the available balance of the Card. If the card has expired when the products are returned, the value of the product will be credited to a Credit Voucher that will be delivered to the customer, either online, if he made the purchase through our online store, or in the physical store, when he has made the buy it in our physical store.

Gift cards cannot be redeemed in stages, but only in a one-time transaction, at any time within 6 months of their purchase, with a selection of products of equal or greater value, making up the difference in price.

NOTE: Based on the Greek legislation and in particular according to par. 4 of article 7 of the Code of Taxation for the Representation of Transactions (Law 4093/2012) a retail receipt or invoice is issued at the time of sale, upon delivery or when the shipment of the goods begins. Therefore, when purchasing the gift card, no retail receipt is issued, as no delivery-sale of goods takes place, but the purchase of a right in favor of a third party which is incorporated in the gift certificate.

6. Payment and product prices

1. All prices on sportfree.gr are in euros and include the statutory VAT.
2. Upon completion of the selection of products, the customer can choose the payment method displayed, namely:

1. Online payment by credit card, debit card or prepaid
Visa, MasterCard, Maestro or Paypal.

2. Deposit to a bank account
For payment by deposit to a bank account, follow these
following steps:
 When completing your order you choose as a method payment "Bank deposit".
 You deposit the amount of money into the following accounts:

3. Cash on delivery

Cash payment to Courier upon receipt of your order. There is no additional charge for cash on delivery payment.

CASH PAYMENT IS NOT SUPPORTED IN CYPRUS.

 

4. Payment upon receipt from the store

If you choose to receive the order from the store, payment is made upon receipt at the store cashier.

Transactions over €500.00 are not allowed to be carried out in cash, therefore it is not possible to choose in this case cash on delivery.

4. Maestro, MasterCard and Visa debit, credit and prepaid cards are accepted. Payment details are encrypted during processing. All online card payments are made in the secure protected environment of the partner payment platform. The data entered by the customer when making an electronic payment are not controlled, processed or stored by sportfree, but by the respective provider and/or payment server. Please note that the secure payment system may ask you to confirm the transaction via 2-factor authentication by sending you a text message or email with a unique code, provided you already have your card-issuing bank's online banking codes.

5. If payment by bank deposit is selected, your order is prepared after the bank transfer appears in the corresponding eshop-spot bank account. The time of completion and appearance of the bank transfer may vary depending on the Bank (usually 2-3 working days). If the deposit is not made within 3 working days, the order is automatically cancelled. Any charges when making bank transfers, imposed by the banks, are borne by the customer.

6. In the event that a refund is required, this will be carried out by eshop-spot in the same way as the customer paid the price, unless otherwise agreed with the customer, without fault or unjustified delay. When the payment by you has been made by depositing into our account, or by cash on delivery, for the refund, you will have to tell us the IBAN of your account, in which the beneficiary is the person who submitted the order in our online store.  

 

7. Retention of title
Products that may have been delivered to you without being fully or partially paid for remain the property of sportfree until final, full and complete payment of the price.

Order delivery methods and times

A) Methods of delivery

You can receive your order in 2 ways:
• By courier (or shipping company if it is a bulk order)
• Upon receipt from our physical store (K. Karamanli 137)

The courier company we work with is ACS Courier.

B) Delivery time

1. Orders received by us are processed on the next business day. The delivery time is solely up to the courier companies, but may also be affected by the payment method you have chosen (e.g. the completion and appearance time of the bank transfer may vary depending on the Bank (usually 2-3 working days)

2. The delivery of your order within the Greek Territory will be carried out, if possible, within 3-5 working days, unless special conditions affect the load of courier companies and cause extraordinary delays. In case of hard-to-reach or remote areas (eg islands or remote provinces), the shipping and delivery of your products may take longer, usually 2-5 working days more. In any case, the delivery of the order will not exceed 30 days, except in cases of force majeure (transport strikes, bad weather, or periods of heavy workload of couriers, etc.).
3. The delivery of your order within the Cyprus Territory will take place, if possible, within 8-10 working days, unless special circumstances affect the load of courier companies and cause extraordinary delays.

For packages weighing more than 2 kg there is an additional charge of transport costs depending on the weight of the package and the volume (please contact us for more information). If an order exceeds the above conditions, in terms of volume and weight, then the buyer is always informed of any additional charges.

The costs of returning products that we sent to you that are defective or incorrect are borne by us, as long as you return them with the courier company cooperating with us that delivered them to you.

You are responsible for the return costs of non-defective products.

The prices listed in this paragraph include VAT.

In any case and for the complete information of the customer, the final transport cost is calculated in the basket.

 

10. Check products upon receipt

Upon delivery you must check the products you receive, as after this you bear the risk of their accidental destruction, deterioration or loss. Your signature on the receipt form means that you acknowledge that you received the products of your order correctly and that they are not defective.

11. Non-receipt of products

If the customer does not receive the product within 30 days after receiving the notice to ship and despite the relevant notification from the carrier, sportfree reserves the right to withdraw from the sale. In such event, the customer will receive a credit note equal to the sale price, less shipping costs, which will be paid by sportfree in the same way that the customer paid the price.

In the event that you wish to receive the products again, the costs of reshipping them will be borne by you, regardless of the amount of the order.

13. PRODUCT RETURNS/EXCHANGES

Right of withdrawal / Return of non-defective product

Please note that for any return or exchange of products, a necessary condition is the attachment of the receipt.

 

A) Returns of non-defective products

If the customer is a natural person (consumer) who makes the sale for personal use and not for the service of his professional activity, then he is entitled to withdraw from the sale within 14 calendar days, which start from the delivery of the product (to the customer or to the carrier indicated by the latter), returning the product in its original condition, bearing the return costs and any reduction in the value of the products.

It is not possible to return the following categories of products: a) seasonal products, after the end of the season, b) underwear, socks and swimwear and safety shoes, for health and safety reasons, c) personalized products that we have made to your order (eg clothes with logo print etc).

You can return the rest of the products as long as they are in their original condition, intact, complete, without any wear and tear, and are returned within 14 days from the date of receipt of the order. Products should not have their tags removed or worn, washed, or used in any way other than necessary testing. In the event that the product you are returning is found to have suffered damages or alterations that are not attributable to the result of the handling of the goods necessary to establish the nature, characteristics and function of the goods, the return may either not be accepted if the product is unfit for resale, or otherwise be refunded less the amount of the product's decline in value (see clause 15 below).

 

B) Product changes

Also, you can exchange the product you bought for another one again within 14 days from the date of receipt of the first one.

CHANGE OF PRODUCTS

It is not possible to change the following product categories: a) seasonal products, after the end of the season, b) underwear, socks and swimwear and safety shoes, for health and safety reasons, c) personalized products that we have made to your order (eg clothes with logo print etc).

The products that are exchanged must be in the condition they were received, without damage and their packaging must be the one that accompanied them in perfect condition, together with the tags and labels.

 

The change process is as follows:

• Contact us by email at our email address info@eshop-spot.com or by phone at +30 2310888174 expressing the intention to change the product.

You need:
 the order code sent to you by e-mail when the order was placed
 the product code and the number you want to change
 the product code and the number you want to receive (it can be the same or another product)

• You pack the product you want to change
• You give it to the courier when you pick up your order again. In other words, DELIVERY and PICKUP of the new product to the courier take place at the same time.
• The transport costs for the change are €5
(concerns 2 courier shipments from and to the recipient)
and is done with:

a) deposit to our bank account

Or

b) by cash on delivery.
If there is a price difference between the products being exchanged, it is added to the shipping cost if it is more expensive or subtracted from the shipping cost if it is cheaper. In the case of an additional difference of a smaller price, this will be refunded to you in the same way as you paid for your order.

14. Ways to exercise the right of withdrawal:

You have the right to withdraw from the distance sale of non-defective products, exclusively within a period of 14 calendar days, by returning the product in its original condition. This right begins on the day of receipt of these instructions in writing, however not before the delivery of the products. The return of the products within 14 calendar days or the sending of the clear declaration of withdrawal accompanied by the return of products, will be considered a timely exercise of the right of withdrawal.

In any case, for the return to be accepted, the product must be accompanied by the proof of purchase. The declaration of withdrawal is sent in writing to the following details:
• By registered letter to the sole proprietorship "SOFIA HAMAM", based in Thessaloniki (K. Karamanli 137, Postal Code 54249) find here a sample withdrawal form)
• or by email to the email address: info@eshop-spot.com (here is a sample withdrawal form)

Fill in the required information directly in the form, sign it and send it in one of the above ways.
The products are returned at the customer's expense to the address: Sofia Hamam, K.Karamanli 137-Thessaloniki, Postal Code 54249.

15. Consequences of withdrawal

In the event of a valid exercise of the right of withdrawal, any reduction in the value of the goods, as well as any benefits deriving from this reduction, should be compensated with monetary compensation, only in the case and to the extent that this is due to the management of the product in a manner which avoids the usual examination of the products in a manner other than that necessary to establish the nature, characteristics and function of the product. By ordinary examination and handling of the product in order to ascertain the nature, characteristics and function of the product, is meant the examination of the relevant goods, as this may be done in the manner customary in a physical store.

The customer is responsible for the return costs and any reduction in the value of the product, for the determination of which sportfree expressly reserves the right to determine until receipt of the returned merchandise. Once the product has been received and checked for any impairment of its value, any monetary obligation owed to the customer (e.g. delivery costs, price) will be refunded to the customer in the manner in which such payment was made by the customer, unless otherwise agreed with him. The refund obligation will be fulfilled without undue delay and within 14 calendar days of the return of the product.

The right of withdrawal from the provisions of Law 2251/1994 does not apply:
 In cases where the products have been used. Use of a product constitutes e.g.: sewing it, washing it, ironing it, cutting it, placing components or additional materials or parts on the product, etc.
 In cases where the delivered products are not suitable for return once unsealed for health protection or hygiene reasons (eg underwear, socks, swimwear, safety shoes, etc.).
 In seasonal products after the end of the season.

Reduction of product value - return of value

The consumer may incur a reduction in the value of a product if the handling he has done to it exceeds the acceptable measure of examination he would do in a physical store to check its nature, characteristics and operation. In case of valid exercise of the right of withdrawal and provided that the product has been returned to Sportfree, the customer will receive a credit note equal to the value of the sale, which will be paid by Sportfree in the same way as the customer the payment of the price, unless otherwise agreed with the customer, without fault or unjustified delay. Sportfree will refund any payment received within 14 calendar days from the day on which it was informed of the decision to withdraw from the contract. Sportfree reserves the right to refuse a refund until the product is returned to it or until the consumer provides proof of dispatch of the product, whichever occurs first. Sportfree is entitled to withhold from the returned amount the return costs, which are borne by the customer as well as any compensation in case of destruction, wear or damage to the product or reduction in the value of the product due to the actions of the customer, which normally amounts to 20 % of the original sale price (and not any discount or offer price). In any case, Sportfree is entitled to claim in any legal way any amount that was damaged (indicatively, either with regard to return costs or with destruction, wear or damage, impairment of the value of the product, etc.).

 

Right to return, correct or replace defective products

The products shown in our online store may differ in color from reality (due to various factors such as the characteristics of photography, lighting during photography, screen resolution, etc.). Such deviations cannot be characterized as deficiencies in the agreed quality or as a defect of the products you order.

1. The customer is also entitled, within the legal time frames and, regardless of the above-described right of unwarranted withdrawal, to exercise any of the rights granted by law due to product defects (correction, replacement, price reduction or withdrawal), and in accordance with the conditions of the law, additionally by submitting a direct request to eshop-spot.
2. In case of a defect, you can send an email to info@eshop-spot.com with all the necessary information.
3. If a product is declared defective by the customer, sportfree expressly reserves the right to diagnose the product as such in order to replace it with a non-defective one or to repair it, if possible.
4. If the defect is insignificant, the right of withdrawal is not granted by law.
5. If the defect can be corrected or replaced, the customer must accept the correction or replacement, unless its exercise is unprofitable for the customer.
6. If a product is returned as defective and sportfree, after the above check, determines the existence of a defect, the customer can be informed about the replacement or correction process.
7. The assignment or transfer of rights regarding the defectiveness of the products is excluded.

 

16. Consumer Rights - Liability - Force Majeure

3. The rights of consumers from the provisions on the sale of consumer goods and guarantees of the Civil Code and the Consumer Protection Act, as well as from any other relevant provision, apply as provided for in the above legal provisions.
4. Customer claims for compensation or monetary satisfaction of any kind and legal basis are excluded. In particular, claims for damage to health, life and physical integrity are excluded.
5. Any claim for compensation or financial satisfaction of any kind and legal basis is excluded, in case of force majeure.

17. Right to return, correct or replace defective products

18. Final Provisions

1. These general terms and conditions are governed by Greek law.

2. For any dispute between sportfree and the customer, the competent courts of Thessaloniki are responsible for its resolution. For the out-of-court resolution of the dispute, you can also contact the competent bodies for the out-of-court settlement of consumer disputes, e.g. to the General Consumer Secretariat of the Ministry of Development and Competitiveness (Pl. Kaningos, 10181, Athens, www.efpolis.gr, tel.: 1520, fax: 2103843549), to the Consumer Advocate (www.synigoroskatanaloti.gr, 144 Alexandras Street, 114 71, Athens, tel.: 2106460734, fax: 2106460414.), to the Committees for Friendly Settlement of consumer disputes (article 11 of Law 2251/1994) which are based in the local Municipalities of the country. You can also address the European Alternative Dispute Resolution Body, on the relevant Online Dispute Resolution (ODR) platform of the European Commission: https://ec.europa.eu/consumers/odr.

3. The protection of distance contract laws, as well as these terms, applies to transactions only with natural persons, who transact for reasons that do not fall within their commercial, craft, business or independent professional activity.

4. In case of non-application of any term of this agreement, the others remain in full force and effect.
